My gut feeling is that it was not a set up. I believe BO/BS’s legal team, DHS, DOJ and Sec. of Defense Panetta prepared a “findings/judgement” for Malihi to sign. They “convinced” Malihi that it would start a race riot and civil war and it was in the best interest of national security and safety of the subjects to cover up the issue. My gut feelings are seldom wrong.
